New York Truvada Lawsuit Attorneys

The human immunodeficiency virus (HIV) has met much resistance from the medical field as of late with innovative drugs and measures being developed that have helped to reduce its spread and growth. One particular company appeared to be trustworthy and dependable. Unfortunately, recent lawsuits have shown that Gilead Sciences Inc., have a lot of questionable business practices to answer for.

It is alleged that Gilead knowingly marketed Truvada as safe despite its serious side effects by concealing information from the Food and Drug Administration (FDA). The company would go on to secure billions in profits from users of their drug and government healthcare programs.

To make matters worse, Gilead hid a better, safer alternative.

Now, Truvada users that were betrayed by the company are coming forth in an effort to relay their grievances with the company and seek recovery. To do so, they need strong legal representation, and with years of experience in taking big corporations to court, none do it better than the New York Truvada lawsuit lawyers of Onder Law Firm.

If you or someone you love has been inflicted with severe side effects and complications due to using the HIV drug, Truvada, do not hesitate to contact us at (314) 310-7924 to set up your FREE legal consultation with the best New York Truvada lawsuit lawyers.

What Does Truvada Do to the Body?

Truvada was originally designed to reduce the replication of HIV-infected cells by slowing down the activity of a certain hormone that the virus uses to grow. This hormone is known as reverse transcriptase.

Truvada gave many people who live with HIV, as well as others at high risk of infection, a sense of hope and safety. The medicine accomplished this through several components including tenofovir disoproxil fumarate (TDF).

Truvada wasn’t the only TDF-based medicine. Other TDF-based drugs have included:

  • Atripla
  • Complera
  • Stribild
  • Viread

Even with all of the good that these drugs may do for people living with HIV or for people in high risk of contracting the virus, these medications have been linked to severe bone and kidney complications.

In short, studies suggest that TDF can cause the body to lose calcium and other minerals that make bones strong, often leading to a condition known as bone demineralization.

This condition usually turns the users of Truvada’s bones brittle, making them more susceptible to breaks and fractures. In fact, approximately 6,000 users of the TDF drug have broken bones.

Bone complications that Truvada has been found to cause include:

  • Discomfort in Extremities
  • Decreased Bone Mineral Density
  • Bone Deterioration or Osteoporosis
  • Bone Loss or Osteopenia
  • Dental Complications (e.g. Tooth Decay and Loss)
  • Bone Fractures

While bone complications remain a real threat from taking the medication, kidney complications have also been known to arise. Large amounts of TDF are required in order to be an effective treatment toward the development of HIV, leaving it up to the kidneys to flush out the excess through the urine.

As TDF accumulates within the kidneys — along with calcium loss from bones — it begins to cause a series of kidney complications such as:

  • Chronic Kidney Disease
  • Declining Kidney Function/Decreased Urination
  • Acute Kidney Injury
  • Acute Renal Failure
  • Fanconi Syndrome
  • Kidney Failure

Lastly, Truvada has also been linked to the development of lactic acidosis, a condition that elevates the body’s pH levels and effectively turns it more acidic. This condition can cause muscle aches, burning sensations, stomach cramps, nausea, rapid breathing, and even death.

New York HIV Patients and Truvada

In the State of New York, roughly 127,934 individuals are living with HIV. This signifies a rate of 760 people per 100,000. Of this number:

  • 6 percent are African-American
  • 4 percent are Hispanic/Latinx
  • 8 percent are White

Out of those living with HIV in 2016, 71.3 percent were male and 28.7 percent were female. That same year, HIV would claim 1,840 lives, reflecting a rate of 11 deaths per 100,000 people. In 2017, 2,768 new cases of HIV were diagnosed, which reflects a rate of 16 new diagnoses per 100,000 people.

Kings County contained the highest rate of people living with HIV in 2016 with around 1,210 per 100,000. Queens and Orleans Counties also had high rates with 789 of everyone 100,000 and 678 of every 100,000 people respectively.

Previous Gilead Sciences Inc. Lawsuits

Gilead has faced many legal troubles throughout its entire operation, but some of the more recent lawsuits are extremely relevant to current claims as they reveal just how far Gilead is willing to go to put users harm’s way for the sake of profit.

The Tenofovir Alafenamide Fumarate Lawsuits

Across the nation, in California, two gentlemen filed personal injury lawsuits against Gilead. The lawsuit claimed that the company had a safer alternative to the TDF-based medications since the early 2000s.

This component — known as tenofovir alafenamide fumarate (TAF) — offered the same effectiveness at stopping the replication of HIV-infected cells at a much lower, safer dose than TDF-based medications like Truvada.

Instead, Gilead opted to shelve TAF-based medications and sell their TDF-based medications at exorbitant prices until their patent expired in 2015. This move would guarantee protection from competitors, securing the company’s profits at the sake of users’ well being.

The lawsuit, claims that Gilead allegedly knew about the negative side effects before they decided to sell their TDF-based medications.

Thanks to these two gentlemen, much of Gilead’s dirty laundry is set to air out in civil court as the two have not only filed their own personal injury lawsuits, but also a class action lawsuit meant to help others that have been affected by the drug to come forward.

The People Who Use Truvada

Within the United States, 136,000 individuals are using Truvada. That means that 136,000 individuals are at risk of developing severe bone and kidney problems.

This is especially true for gay and bisexual men. Particularly gay and bisexual men of color.

According to an NBC News article, 35 percent of gay and bisexual men use HIV medications like Truvada to help stop the growth of HIV or prevent contraction of the condition.

87 percent of Latinos, 86 percent of African-Americans, and 95 percent of White gay and bisexual men know about Truvada and its uses. 30 percent of Latinos, 26 percent of African-Americans, and 40 percent of White gay and bisexual men actually take a medicine containing TDF.

The next demographic that is at risk of developing bone and kidney complications are women, especially women of color. The Center for Disease Control and Prevention (CDC) states that out of 78,360 people who filled prescriptions for the drug in 2016, 4.7 percent were women.

Let’s not forget about the men and women who also are at high risk of contracting the disease through their occupation. Nurses who treat patients that live with HIV are at risk of contracting the virus and as such may take Truvada to help minimize those risks. Prison guards also take Truvada if they are handling a prisoner that lives with HIV as well.
