Wisconsin Truvada Lawsuit Attorneys

As of 2016, approximately 6,070 people in Wisconsin are living with the human immunodeficiency virus (HIV), which is the equivalent of 125 people living with the virus per 100,000 people. To help control the growth and spread of the virus, many of these individuals have turned to pharmaceutical companies like Gilead Sciences Inc. to manufacture a drug that can help them do just that.

Thus, Truvada was manufactured. This medication controls HIV replication through its active ingredient called tenofovir disoproxil fumarate (TDF), which was recently found to cause debilitating kidney and bone complications within Truvada users. To make matters worse, Gilead knew about the side effects and did nothing to warn their consumers.

Now, thousands of HIV positive users are coming forward with their tragic stories of pain and loss in order to bring the pharmaceutical giant to justice. With the knowledgeable Wisconsin Truvada lawsuit lawyers of Onder Law Firm, you get the experience you need from a law firm that has won many product liability claims, earning millions in damages meant to cover medical expenses, pain and suffering, and lost wages for their clients.

Overview of Wisconsin HIV Statistics

The majority of Truvada users generally fall within the demographics that are mostly affected by the development of HIV. From the 6,070 people that are living with HIV in Wisconsin, around:

  • 2% were African-American
  • 3% were Hispanic/Latinx
  • 6% were White
  • 1% identified as a male
  • 9% identified as female

While the numbers reflected throughout Wisconsin’s counties are remarkably low, some of the key counties that are affected the most by HIV are:

  • Adams County – 117 people living with HIV per 100,000.
  • Dodge County – 126 people were living with HIV per 100,000.
  • Racine County – 140 people had been living with HIV per 100,000.
  • Dane County – 148 individuals contracted the virus per 100,000.
  • Milwaukee County – 365 individuals had lived with HIV per 100,000.

Sadly, however, about 81 people passed away due to complications related to HIV in 2016. The following year, 259 new cases of HIV were diagnosed, or 5 new cases of HIV per 100,000 people.

Out of these new diagnoses, it was found that men contracted the virus through:

  • Male-to-Male Sexual Contact (76.7%)
  • Male-to-Male Sexual Contact and Injection Use (8.1%)
  • Injection Drug Use (7.3%)
  • Heterosexual Contact (6.6%)
  • Other (1.3%)

Women, on the other hand, were found to have contracted the virus from:

  • Heterosexual Contact (76%)
  • Injection Drug Use (20.9%)
  • Other (3.1%)

In order to treat and control HIV, 1,099 people living with the virus or those at high-risk circumstances of contracting it were prescribed Truvada in 2018. That means for every 100,000 people living in Wisconsin, around 22 of them were prescribed the TDF drug that is responsible for the development of chronic kidney and bone complications in its users.

What You Should Do if You’ve Been Injured by a Defective Product

If you are taking Truvada with other HIV medications to control or prevent the spread of the virus and have suffered any kind of kidney or bone complications, it is best to consult with your doctor. In some circumstances, your doctor may want to run a few tests designed to measure the extent of bone density loss or kidney damage. If the hospital documents your injuries in an incident report, this could be submitted as evidence in your case.

Once your doctor has confirmed that the injuries you have sustained are related to your Truvada use, the next step is to find an experienced product liability lawyer. Gilead Sciences Inc. and Their Questionable Past

Since 1987, Gilead Sciences Inc. has manufactured drugs that have made a difference in people’s lives; whether that difference is good or bad is still left up for debate. During the last 30 years, the company has been the focal point of many lawsuits alleging that they:

  1. Essentially bribed doctors and personnel of medical centers and laboratories through kickbacks to write and sell their HIV and Hepatitis B drugs.
  2. Acquired active ingredients for their drugs from an unapproved source in China, which was later determined to be contaminated.

However, Gilead’s most current legal troubles stem from two lawsuits filed in the California civil court by two gentlemen who sustained injury through Truvada use. The lawsuit alleges that the company had withheld a safer drug that works just as effectively as TDF-based medicines like Truvada but at lower, safer doses.

Tenofovir alafenamide fumarate (TAF) was manufactured alongside TDF-based medications like Truvada in the early 2000s, but it was shelved early into its development so that Gilead can profit from TDF medications throughout its patent, which ended in 2015. As a result, the company generated around $11 billion in Truvada sales per year.

Then, when the patent expired on Gilead’s TDF-based products, they would sell TAF-based products like Genvoya as a new and improved formula, securing their patent and generating much more revenue through deceitful means.

Gilead knew since Truvada’s early design process back in 2001 that it was capable of doing real damage to user’s bones and kidneys, but they marketed it anyway for the sake of profit. Now, many are coming forward to sign on into the class action lawsuit filed by the two California men in order to seek out restitution.

While class action lawsuits send a strong message to pharmaceutical companies to shy away from these types of devious business practices, it does little in getting the full monetary value for your claim. With the right legal team, however, you can file a product liability claim against Gilead for deceiving you for the sake of profit and win every cent of compensation that is owed to you.

The Side Effects and Complications Cause by Truvada

How Truvada works is a straightforward process. This pill is taken orally, where excessive amounts of TDF is distributed throughout the body. TDF actively seeks out an enzyme called reverse transcriptase and successfully reduces its activity. Doing this ceases the replication process of HIV-infected cells.

Over time, this excess of TDF can wreak havoc on the user’s kidneys. As this substance pools within these organs, overproduction of serum creatinine occurs, signaling the first stages of chronic kidney disease. Without treatment, this can progress to life-threatening kidney complications such as:

  • Declining Kidney Function/Decreased Urination
  • Acute Kidney Injury
  • Acute Renal Failure
  • Fanconi Syndrome
  • Kidney Failure

At the same time, excess amounts of TDF can also affect how bones are maintained by the body. Tenofovir DF can cause bone to lose much of its calcium and other minerals, leaving behind bones that are brittle and much more susceptible to fractures. If left untreated, these diseases can progress into:

  • Discomfort in Extremities
  • Decreased Bone Mineral Density
  • Bone Deterioration or Osteoporosis
  • Bone Loss or Osteopenia
  • Dental Complications (e.g. Tooth Decay and Loss)

If you are someone that is already suffering from preexisting kidney or bone complications, taking Truvada can exacerbate these complications to dangerous levels. It is also not uncommon for people who are taking the drug to report cases of lactic acidosis, a condition where the body becomes more acidic. This condition can produce muscle aches, burning sensations, stomach cramps, nausea, rapid breathing, and even death.
